EnergyAustralia, one of Australia's largest energy companies, has issued a formal apology to over 400,000 customers regarding its carbon offset scheme, acknowledging that such offsets do not prevent or reverse the environmental damage associated with fossil fuel consumption.

This concession follows a lawsuit initiated by the advocacy group Parents for Climate, set to be heard in the NSW Federal Court.

The lawsuit, filed in August 2023, accused EnergyAustralia of misleading customers through its Go Neutral products, which were marketed as 'carbon neutral' based on the purchase of carbon offsets.

Parents for Climate, which comprises more than 20,000 members, described the acknowledgment as a significant victory for Australian consumers, potentially establishing new standards for corporate environmental marketing practices.

In a statement released on Monday, EnergyAustralia addressed the marketing claims, recognizing that carbon offsets, while facilitating investment in projects aimed at reducing greenhouse gas emissions, do not mitigate the emissions produced by burning fossil fuels for energy.

'Even with carbon offsetting, the emissions released from burning fossil fuels for a customer’s energy use still contribute to climate change,' the company stated.

The company had dissolved its Go Neutral plans by 2024, with Chief Customer Officer Kate Gibson outlining a shift towards direct emission reduction efforts.

Gibson emphasized that reliance on carbon offsets should not defer critical decarbonization initiatives.

Environmental advocates have expressed the hope that this acknowledgment could lead to more stringent standards governing corporate environmental claims in Australia.

Nic Seton, the CEO of Parents for Climate, criticized the pervasive issue of greenwashing and urged for more transparency and accountability in corporate marketing amidst rising living costs.

Seton highlighted the need for robust regulations around corporate environmental claims, pointing to the delayed review of the Climate Active carbon neutral certification scheme, which has been under scrutiny since October 2023.

The implications of this court case could pave the way for future corporate environmental accountability in Australia, with legal experts suggesting it marks a significant development in the landscape of greenwashing litigation.

According to the Clean Energy Regulator, EnergyAustralia was reported as the third-largest emitter in Australia for the year 2023-2024, serving over 1.6 million customers.
