Australia Strengthens Online Safety Laws to Compel Social Platforms to Remove Abusive Content

Expanded legal authority empowers national regulator to mandate takedowns of harm-causing posts and hold digital platforms to account
Australia has enacted a suite of strengthened online safety laws giving its independent regulator, the eSafety Commissioner, greater authority to require social media platforms and other online services to take down abusive, illegal or harmful content.

The reforms build on the Online Safety Act 2021, a comprehensive legislative framework designed to protect Australians from severe online abuse, child exploitation material and other offensive material, and clarify the regulator’s powers to compel removal of specified content where service providers fail to act.

Under the existing law, eSafety can investigate complaints about serious online abuse directed at adults, facilitate the removal of explicit or intimate images shared without consent and take enforcement action where online services do not comply with removal notices for harmful material.

Platforms that fail to take down content subject to a notice may face civil penalties for non-compliance.

These powers reflect the government’s effort to ensure digital spaces are safer and more positive for users across the country, particularly children and vulnerable groups.

The legislation positions Australia among jurisdictions with assertive content governance regimes that demand clear accountability from major social platforms.

Advocacy for such reforms has intensified amid high-profile cases of harmful content proliferating on large platforms, pressuring regulators to act decisively when companies do not voluntarily remove abusive posts.

While the law already empowers the eSafety Commissioner to issue removal notices, the enhanced legal regime affirms the expectation that platforms must take “all reasonable steps” to remove or restrict access to seriously harmful material when notified and provides mechanisms for enforcement if they do not.

Supporters of the strengthened regime argue it balances free expression with necessary protections from violence, harassment, exploitation and other forms of online harm, reflecting the Australian government’s commitment to digital safety and user wellbeing.
