An Australian fashion designer has won a landmark legal battle against global pop star Katy Perry after the country’s highest court ruled that the designer’s trademark can remain in place following nearly seventeen years of litigation.

The dispute centred on Sydney designer Katie Taylor, who was born Katie Perry and built a clothing label using that name.

She first registered the "Katie Perry" trademark for apparel in Australia in two thousand eight and launched her fashion business soon afterwards.

The conflict began when the American singer Katy Perry, whose birth name is Katheryn Hudson, expanded her brand and sold merchandise bearing the name "Katy Perry" during tours and online promotions connected to her performances in Australia.

The designer argued that the sale of branded clothing under the pop star’s name infringed on her registered trademark.

Legal proceedings over the issue stretched across more than a decade and passed through several courts.

The designer initially succeeded in a two thousand twenty-three Federal Court ruling that found the singer’s merchandise activities had infringed the trademark.

That decision was later overturned on appeal in two thousand twenty-four, temporarily cancelling the designer’s trademark and setting the stage for a final challenge in the High Court.

In a closely divided decision, a majority of High Court judges ruled that the designer’s "Katie Perry" trademark was valid and did not breach Australian trademark law.

The court concluded that the brand did not create a likelihood of consumer confusion with the singer’s name in relation to clothing products.

The ruling also determined that merchandise sold in Australia under the "Katy Perry" label had infringed the designer’s trademark rights.

Judges described the continued sale of clothing products using the singer’s name despite the existing trademark as deliberate conduct.

The judgment allows the Australian designer to retain her trademark and continue operating her clothing brand under the name "Katie Perry." However, some procedural questions, including aspects related to the timing of the legal action, have been referred back to a lower court for further consideration.

For the designer, the outcome represents the culmination of a prolonged legal fight that she has described as a defence of small business rights.

The case has drawn wide attention in legal and business circles because it highlights the complexities of trademark protection when globally recognised celebrities and local entrepreneurs use similar names.

The dispute began in two thousand nine shortly after the singer’s international breakthrough and continued through years of legal appeals, making it one of the most prominent trademark conflicts in Australia’s entertainment and fashion industries.

The High Court’s decision is expected to influence future intellectual property disputes involving personal names and branding, particularly when international fame intersects with locally registered trademarks.
