CHOICE Files Super Complaint Over Energy Retailers' Pricing Practices in Australia

In a move aimed at exposing alleged deceptive practices in the energy market, the consumer advocacy group CHOICE has filed a super complaint with the Australian Competition and Consumer Commission (ACCC) against energy retailers.

CHOICE claims these retailers are engaging in pricing tactics that create confusion, which they describe as the 'stuff of nightmares' for consumers.

This complaint comes as part of CHOICE's efforts utilizing newly granted powers that require a response from the ACCC within 90 days.

According to CHOICE, energy retailers are launching new plans under the same names as existing options to evade requirements that inform consumers about better offers.

This tactic reportedly costs customers an average of $171 annually, with one electricity user missing out on as much as $588 per year.

CHOICE estimates that approximately 25% of customers receiving notifications of the 'best offer' were already subscribed to plans bearing identical names, leading to an aggregate financial toll of around $65 million on consumers.

A report from December by the ACCC on the National Electricity Market indicated that approximately 80% of Australians were not on the best plan available from their energy retailers.

Ashley de Silva, the chief executive of CHOICE, emphasized the complications consumers face in obtaining clarity on their energy bills, stating, 'It shouldn't be this hard to know if you're being ripped off on your energy bill.' CHOICE is urging the ACCC to undertake rigorous enforcement actions to address these practices.

In response to the allegations, the Australian Energy Council (AEC), which represents energy retailers, has dismissed CHOICE’s claims as incorrect.

The AEC's chief executive, Louisa Kinnear, stated that the Australian Energy Regulator (AER) rejected past propositions to amend the wording on energy bills aimed at better communicating the best offers available.

She noted that the 'Better Bills' guidelines established by the AER dictate the language retailers must employ when informing customers about pricing.

Kinnear indicated that the ACCC has been aware of the matter for an extended period and that energy retailers have been engaged in prolonged discussions with the AER to explore alternatives for clearer communication.

In a submission to the AER earlier this year, the AEC contended that there was insufficient evidence to conclude that the existing messaging about 'better offers' had failed to motivate more consumers to select the most economical plans.

The AER is currently reviewing options to enhance clarity in the consumer energy space, as industry stakeholders navigate ongoing discussions regarding pricing transparency.
