Mosaic Brands Collapse: 2,800 Displaced Workers Granted Fast-Tracked Access to Entitlements

Mosaic Brands Collapse: 2,800 Displaced Workers Granted Fast-Tracked Access to Entitlements

Federal government intervenes to assist employees following the bankruptcy of clothing retailer Mosaic Brands, expediting access to unpaid wages and entitlements.
In a significant development following the collapse of Mosaic Brands, nearly 2,800 workers have been granted expedited access to unpaid wages and entitlements through the Fair Entitlement Guarantee (FEG), a government safety net scheme designed for employees terminated by companies in financial distress.

Mosaic Brands, which owned several low-cost clothing labels including Rivers, Millers, and Katies, entered administration in late October, leading to the closure of approximately 700 stores nationwide and resulting in substantial job losses.

The decision to allow early access to the FEG was influenced by advocacy from the SDA Union, which represents retail employees.

This action enables affected workers to claim their entitlements without having to wait for the company's formal liquidation process, which can often prolong the payment timeline.

Many former employees have been left without pay since October, prompting urgent calls for government intervention.

Minister for Employment and Workplace Relations, Murray Watt, articulated the need for swift action, particularly noting the demographics of the affected workforce, which predominantly consists of women and part-time workers.

He stated, 'It was for me why there was a strong case for us to act early.' This decision aligns with previous government measures that provided similar expedited access for employees of other collapsed companies, such as Rex Airlines.

Under the FEG provisions, eligible workers may reclaim up to 13 weeks of unpaid wages, along with accrued entitlements such as annual leave and redundancy payments based on their years of service.

The enrollment process will be facilitated online, with former employees required to submit their claims within a year.

Once the FEG is activated, the government assumes priority creditor status, allowing it to recoup funds from the liquidated company's assets.

The SDA Union welcomed this decision, emphasizing the hardships faced by lower-paid workers during this turbulent time.

Union leaders have advised affected employees, however, to temper their expectations regarding the speed of payment, suggesting that while payouts will be forthcoming sooner than anticipated within the liquidation timeline, they are not immediate.

Mosaic Brands is projected to close all remaining stores by mid-April, with around 320 outlets yet to shut down as existing inventory is sold.

The financial turmoil surrounding the retailer has raised concerns, with reports indicating that the company owes creditors a total of at least $740 million.

According to KPMG, the appointed receivers and managers, while there is cautious optimism about employee compensation, the precise timing for payments remains unclear.

In a precarious financial outlook, unsecured creditors, which include suppliers and landlords, may face potential losses, as KPMG’s findings suggest insufficient funds will be available to settle their dues.

Conversations between suppliers and the company prior to the collapse revealed significant unpaid invoices, with attempts by the CEO to negotiate reductions in owed amounts leading to growing tensions within its supply chain.
